According to the complaint, the alleged victim was operating a motor vehicle on Interstate 70 in Madison County, Ohio¸ when the left rear duals on a tractor-trailer operated by the Defendant driver and owned, leased or rented by Swift, separated from the vehicle.The brake drum crossed the median, forcefully striking the vehicle in which Plaintiff was traveling, leaving him severely injured. Among other things, the complaint alleges that the Defendant driver carelessly and negligently operated the tractor-trailer in such a way that the left rear duals were separated from the vehicle. The lawsuit further alleges that the driver of the vehicle and Swift negligently failed to adequately inspect and/or maintain the tractor-trailer, and that the collision between the Plaintiff’s vehicle and the brake drum from the tractor-trailer would not have occurred but for the negligence of the Defendants.
The lawsuit charges that the Defendants’ negligence and recklessness caused the victim to sustain severe and permanent injuries, including but not limited to injuries to his back, left wrist, left knee, head, and neck; current and future medical expenses; great pain and suffering, both physical and emotional; loss of ability to perform usual functions; and current and future lost wages. The alleged victim is seeking both compensatory damages, as well as punitive damages for Defendants’ alleged willful, wanton, malicious and conscious disregard for the safety of others, including the Plaintiff.
