According to the complaint, one of the Plaintiffs was severely injured when a 2009 Peterbilt tractor-trailer owned, rented or leased by Stevens Transport and operated by the Defendant driver collided with his 2010 Chevrolet Malibu in Allen County on June 4, 2010. At the time of the collision, the driver of the tractor-trailer was attempting to turn left onto N. West Street from the right-hand lane of W. Wayne Street, and crossed into the left-hand lane of W. Wayne Street. This maneuver caused the tractor-trailer to collide with the Malibu operated by the Plaintiff, which was located in the left-hand lane of W. Wayne Street, according to the lawsuit.
As a result of the collision between the Malibu and the tractor-trailer, the Plaintiff suffered severe, permanent and progressive personal injuries, including injuries to his abdomen, chest, hands, head, hip, legs, neck and spine. The lawsuit alleges that the damages sustained by the Plaintiffs were the direct and proximate result of the collision, and the negligent acts and/or omissions of Stevens Transport and its driver. The complaint seeks compensatory damages on behalf of the driver of the Malibu for among other things, past, present and future medical and rehabilitation expenses, psychological anguish, and loss of enjoyment of his life, as well as loss of consortium on behalf of his wife. The lawsuit further seeks punitive damages due to the complete indifference to or conscious disregard the Defendants’ alleged conduct showed for the safety of others, including the Plaintiff.
